Driving
on a Suspended License
Every
year, thousands of people are charged with driving on a suspended license. In
most situations, this occurs during a routine traffic stop, when the officer
learns the driver does not have a valid driver’s license. Depending on the
reason your license was suspended, your New Jersey DUI attorney may have an

you lost your license due to a DMV action, for example, you received too many
points on your record, the DMV must prove they provided adequate and fair
notice to you. Essentially, if you claim to have not known your license was
suspended and they cannot provide reasonable proof that you should have known,

When
you are found guilty of driving on a suspended license, you will face very
severe consequences. A first time offense will result in a fine of $500. Every
case of driving on a suspended license is followed by a yearly $250 surcharge
payable to the DMV. The surcharge will last three years–meaning a first time
conviction will cost a total of $1,250. A second time offense will result in
$750 in fines and up to 5 days in jail. The third offense can by punished by 10
days in jail and $1000 in fines. If any injuries were caused by a driver who
was operating without a license, the jail sentence will be a minimum of 45 days
long.
If
your license was suspended due to a DUI, your penalties will be more severe and
your New Jersey DUI attorney will have a much harder time defending your
actions. Because these suspensions occur in court, the DMV is not held to the
same standard of providing adequate and fair notice about your suspension. You
are expected to know your license is suspended when you are told in the
sentencing. Additionally, your sentence will result in an extra $500 in fines
and your license suspension will be extended to between one and two more years.
You also may be sent to jail for 90 days. As you can see, this will require the
