“DD stores ‘Dunking’ their customers with overcharging”
Think you’re paying too much while picking up your mornin’ Joe? Well, you might be right. Several Dunkin’ Donuts stores in New Jersey and New York have recently been accused of overcharging their customers. Allegedly, these stores charge customers sales tax on tax-exempt items such as bottled water, packaged coffee, and other legally un-taxable products designated “untaxable” by the Division of Taxation. In Ft. Lee, New Jersey, the DD store supposedly charged the the state’s 7% tax on a multitude of items in clear violation of New Jersey code, as was alleged by a law suit filed earlier this month.
A similar case has occurred in Manhattan, in which a customer was charged sales tax on pre-packaged coffee beans, implicating yet another suit. According to Carl Mayer, a lawyer who commented to the New York Post, about a dozen separate DD stores overcharge their customers about 70% of the time. Mayer argues Dunkin’ Donuts stores across both New Jersey and New York have made huge illegitimate profits. He estimates DD stores have profited approximately $10 million off New York customers and $4 million in New Jersey over the course of three years.
In a recent Ocean County Superior Court case, Judge Stephanie Wauters ruled on the issue of child custody between three people. Included in the proceedings was the biological father, his same-sex spouse, and the biological mother, of whom were attempting to create a “tri-parenting relationship.” The biological father, ‘D.G.’ had artificially conceived with ‘K.S.’, who had been friends with both spouses for a long time.
The Personnel Files Act allows any individual to view their personnel file. In this particular case the employee was denied access to their personnel file which violates the law. They were directed to allow access but failed to do so under the auspice that Ms. xx was no longer an employee as she was terminated approximately one week earlier. The Act allows for a reasonable amount of time to request access to your personnel file once you've been terminated. Access to this information can allow further insight into the reasons behind termination.
If you have recently filed or are in the process of filing a bankruptcy petition, be on the lookout for scammers. As reported by the National Association of Consumer Bankruptcy Attorneys (NACBA), the scam is initiated by a phone call to the bankruptcy client with a request that money be sent to the “attorney” making the call. Phone scammers are targeting bankruptcy filers in several states, using personal information from filings and posing as attorneys to get intended victims to immediately wire money to satisfy a debt. NACBA issued a warning that “Under no circumstances would a bankruptcy attorney or staff member telephone a client and ask for a wire transfer immediately to satisfy a debt nor would the bankruptcy attorney and staff ever threaten arrest if a debt isn’t paid.” So far, the two states where this has occurred are New Hampshire and Virginia but consumers should be vigilant. Being charged with a criminal offense can be detrimental to your career, housing, and even getting loans. It is possible to remove these offenses from your record if you go through an expungement. There are certain requirements for different criminal offenses to be expunged, but recently with the passing of new bills, those requirements have been changed to make it easier and faster to get your record expunged.
Getting your vehicle searched can be lengthy, and in some cases unwarranted. A previous court ruling put into place that officers had to have probable cause to call in for a telephonic warrant to search a person’s vehicle. This was said to be a process that should take only 30 mins, but it was becoming apparent that it was taking much longer than this, leaving the police officer and vehicle occupants in serious danger from the passing vehicles on the roadway. To avoid these situations, officers would use a form requesting the driver of the vehicle to sign consenting to a search; this form was used significantly more with minority motorists. Police officers present this document in such a way that motorists feel they have no option but to consent to a search. It is the motorists right to refuse to sign the form and request a warrant be presented in order to search the vehicle, but as of September 24, 2015 this is no longer the case. A new ruling was put into place deeming it allowable for police officers to do warrantless searches as long as the officer feels there is probable cause to consider the vehicle to be containing contraband or evidence of crime. This new ruling rejects the standard in place from the previous ruling which is not in line with the U.S. Supreme Court Standards, based on the Fourth Amendment, because the State of New Jersey feels it is inconsistent with the state constitution.
The State of New Jersey has legalized the use of Marijuana under the 2010 passage of the New Jersey Compassionate Use Medical Marijuana Act with strict guidelines. This has come into question when deciding whether the odor or smoke of marijuana still constitutes probable cause for search. The requirements for use of medical marijuana are clear, stating that the individual must have been prescribed medical marijuana by an authorized physician and entered into a state wide registry. Therefore, the court has ruled that if an individual is authorized to use medical marijuana, that individual would be recognized during a traffic stop by presentation of valid documents, therefore the search would not b e valid without other cause.
