WORKERS' COMPENSATION




What is Workers' Compensation?

Workers’ Compensation is remedial social legislation to insure that employees injured on the job will be paid without regard to fault. The effect of the compensation statute on the covered “employee” is to take away his or her common-law remedies against the “employer” and to substitute in their place a remedy that requires the employer to pay the compensation benefits stipulated in the statute. The right to pay the compensation is the covered employee’s exclusive remedy against the employer. In understanding this rule, the State of New Jersey is self insured for Workers’ Compensation pursuant to N.J.S.A. 34:15-1 et seq.; there is no other insurance involvement. All matters regarding case management and investigations are handled by the Division of Risk Management. The New Jersey State Department of Law and Public Safety, Division of Law, provides legal advice pertaining to claims and litigation support. The Division of Risk Management (DRM) is responsible for the budgeting of workers’ compensation obligations. All workers’ compensation obligations, including payments for medical treatment, temporary and permanent disability, are approved and processed by the Division to the dictates of N.J.S.A.34:15-7 and N.J.S.A.34:15-43.

What is a “Work Related” Injury?

In determining if a reported injury is covered under workers’ compensation, one must first determine if the injury is a direct result of the employee’s employment. The cause for injury must fall under the guidelines pursuant to N.J.S.A. 34:15-1 et.seq.

A work related injury is an injury which occurs out of and in the course of State employment. “In the course of employment” is defined as when employees are at their place of work, during the hours that they are expected to be there and engaged in doing the task that they were employed to do. This does not necessarily mean that the employee would have to be at the employer’s office or premises at the time. The employee could be traveling to or from appointments or doing work at other places designated by the employer. Overtime is included in the equation, as well. In order to be compensable, the accident must result in bodily injury. No compensation is payable for property damage which is the result of the accident. The injury for which a compensable claim is made must be the proximate result of the accident the employee sustained. If there is no such causal relationship, then the employee may not recover benefits.

Child Support is NOT intended for your ex-spouse. It is the right of your child(ren). New Jersey maintains a complex equation based on the respective assets and debts of each spouse.  While this seems relatively straight forward, the law leaves open to interpretation just how long child support will be required.

 Most people don’t realize that in New Jersey, child support does not automatically end when a child reaches 18. Child support often continues until the child finishes college. Since emancipation in New Jersey is not automatic, a person paying child support must formally apply to the Court to emancipate the child to end the support obligation. In determining whether to emancipate, the Court will consider such factors as whether or not the child is a full time college student, whether the child is progressing satisfactorily through college, the age of the child, whether or not the child is working or should be working, and any special needs which the child may have.       

 Emancipation: Emancipation of a child means that the parents no longer bear the burden of supporting the child. All financial duties and obligations cease. However, In New Jersey, there is no set age or condition that triggers emancipation. A complicated, case by case analysis of the child’s circumstances is the process by which New Jersey will release a parent from their child support obligations.

TYPES OF DIVORCE IN NEW JERSEY

Different Types of Divorce Explained 

No Fault Divorce – In New Jersey, you don’t necessarily need to file a complaint against your spouse when seeking a divorce. A No Fault Divorce may suit your needs if (all must be met):
§  You or your spouse has lived in New Jersey for 12 consecutive months prior to filing for divorce.
§  You and your spouse must have experienced irreconcilable differences for at least six months.
§  The irreconcilable differences make it appear that the marriage should be dissolved.
§  There is no reasonable prospect of reconciliation.

Fault Divorce – In New Jersey, despite the No Fault Divorce provision, a spouse can still bring a divorce complaint based on fault against their spouse. These grounds include:
§  Extreme cruelty - In the event a marriage is characterized by physical or mental cruelty, the complaining spouse must subjectively believe that it is unreasonable or improper  to remain cohabitated with the other spouse.
§  Adultery – No proof that adultery occurred is necessary. Rather, the complaining spouse can show by circumstantial evidence that the alleged unfaithful spouse had 1) the inclination to commit adultery, 2) the opportunity to commit adultery, and 3) the ability to commit adultery.
§  Desertion – This complaint is available to a spouse whose spouse has lived outside of the marital home for a period of 12 consecutive months prior to the filing date against the wishes of the complaining spouse.
§  Constructive desertion - This requires a spouse to actually desert a spouse against their wishes for a period of 12 consecutive months. (The 12 month period has to occur prior to the filing of the complaint for divorce.)
§  Habitual Intoxication – Available to a spouse when the other spouse is drunk or using drugs for a year prior to filing.
§  Imprisonment - This requires the spouse to be in prison for a period of 18 consecutive months prior to the filing date.
§  Institutionalization – For this to apply, the spouse must have been institutionalized for 22 years prior to filing.
§  Deviant sexual behavior – This ground for divorce is available to a spouse who has been subjected to depraved sexual conduct against their wishes
